Terms of Service

1. Acceptance of Terms

By creating an account or using the Spotter mobile application (“the App”), you agree to be bound by these Terms of Service (“Terms”). The App is operated by Karl Larson (“we,” “us,” or “our”). If you do not agree to these Terms, do not use the App.

2. Description of Service

Spotter is a workout groups app. Users set weekly workout goals, post photo-based proof of completed workouts, and participate in group-based progress tracking through a social feed and group dashboards.

The App is available on the Apple App Store.

3. Subscriptions and Payments

Spotter offers auto-renewing subscriptions:

• Monthly: $9.99/month
• Annual: $79.99/year

New subscribers receive a 7-day free trial. Payment is charged to your Apple ID account at confirmation of purchase. Subscriptions automatically renew unless canceled at least 24 hours before the end of the current period. Your account will be charged for renewal within 24 hours prior to the end of the current period.

You can manage and cancel your subscription in your Apple ID settings: Settings > [Your Name] > Subscriptions on your iPhone.

4. User Accounts

You must be at least 18 years old to use Spotter. By creating an account, you represent that you are 18 or older.

You must provide accurate information when creating your account. You are responsible for maintaining the security of your login credentials. You must select your sex (male or female) during account setup; this cannot be changed after creation and is used to enforce same-sex social connections.

5. User Conduct

You agree not to:

• Post fraudulent workout photos or falsely represent your activity
• Harass, bully, or intimidate other users
• Use the App for any unlawful purpose
• Attempt to circumvent the same-sex follow restrictions
• Share inappropriate, offensive, or explicit content
• Impersonate another person
• Attempt to access other users’ accounts or private data

The App operates on an honor system. We trust users to post genuine workout proof. Deliberate and repeated abuse of this trust may result in account termination.

6. Account Termination

We reserve the right to suspend or terminate your account at our discretion if you violate these Terms. You may delete your account at any time from within the app under Settings. If you need assistance, contact us at team@beaspotter.com.

7. Content Ownership

You retain ownership of all photos and content you post through the App. By posting content, you grant Spotter a non-exclusive, worldwide, royalty-free license to display, distribute, and store your content as necessary to operate the App and provide the service.

This license ends when you delete your content or your account, except where your content has been shared with others and they have not deleted it.

8. Groups

Users may join groups through invite codes. Groups may optionally be linked to an organization. Group leaders may remove members from their group. Joining a group automatically creates mutual follow relationships with same-sex group members. Leaving a group does not automatically remove these follow relationships.

9. No Warranty

The App is provided “as is” and “as available” without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

We do not guarantee that the App will be uninterrupted, secure, or error-free.

10. Limitation of Liability

To the fullest extent permitted by law, Karl Larson shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, or goodwill arising out of your use of the App.

11. Changes to These Terms

We may update these Terms from time to time. When we do, we’ll update the “Last updated” date at the top of this page. Your continued use of the App after changes constitutes acceptance of the updated Terms.

12. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Minnesota, without regard to its conflict of law provisions.
